Gov. Vetoes Bills Gov. David A. Paterson recently vetoed a package of 39 bills. The package includes: Adult Day Care Slots • A.9319-A (Aileen Gunther)/S.6222-A (John Bonacic)- Authorizes additional adult day care slots in one county. • A.10573-A (William Magee)/ S.7691 (James Seward)— Authorizes additional adult day care slots in one county. • A.11052 (Barbara Lifton)/S.7690 (Seward)— Authorizes additional adult day care slots in one county. • A.11578 (Ruben Diaz Jr.)/S.8625 (Ruben Diaz Sr.)— Authorizes additional adult day care slots in one county. Other bills • A.395-A (Joseph Morelle)/S.6385-A (James Alesi)— Expands the definition of a qualifying small employer for group health insurance under HCRA by removing the requirement that a small business must not have offered health insurance for a 12 month period prior to application. • A.606 (Kevin Cahill)/S.2007 (Dale Volker)—Directs public utilities to provide call center service assistance from centers located within the state and the utilities service area • A.1170 (Gunther)/S.5254 (Diaz Sr.)- Establishes a "certified retirement community" program within the State Office for technology available, including computer models, to develop evacuation time estimates. • A.2554-A (Morelle)/S.3592-A (Alesi)- Creates regional economic development offices to provide assistance in compliance with federal, state and local rules, regulations, permits and licenses. • A.3414-A (William Magnarelli)/S.8356 (Carl Marcellino)- Establishes the New York state greenhouse gases management research and development program. • A.7277 (RoAnn Destito)/S.7337 (Joseph Griffo)- Requires state programs to provide services to individuals with disabilities in the most integrated setting and requires the programs to identify all barriers to communitybased services to ensure that an individual is only in an institutionalized, segregated setting if that individual was unable to benefit from Little)- Provides for the creation of land banks for the revitalization of vacant and abandoned property • A.10508 (Alec Brook- Krasny)/S.7332-A (Martin Golden)- Bars police departments from imposing mandatory retirement or separation from service on the basis of age of police officers age sixty-five or less. • A.10772 (Keith Wright)/S.8648 (Bill Perkins)- Allows NYC to re-convey property taken in a tax foreclosure action. • A.11652 Rules (Crystal Peoples)/S.8606 (William Larkin)- Would require agencies that contract for more that $10 million annually to establish mentor firm/veteran protege programs. • A.11715 Rules (Helene Weinstein)/S.8661 (John DeFrancisco)- Would modify rules for jury selection in civil cases, including by allowing a supervising judge to review trial judge's decisions and allowing an allegedly aggrieved party to seek Article 78 review of decisions in Appellate Division. • A.30000 (Assembly reprint)/S.5425 (Frank Padavan)- Would expand the state tax credit available for the rehabilitation of historic properties. • S.1101-A (Little)/A.2047-A (Janet Duprey)- Would ratify Northern Adirondack central school district's bus purchase despite board's failure to follow voter approval requirements. • S.2879-C (DeFrancisco)/A. 11686-A Rules (Charles Lavine)- Would amend laws governing renunciation of property interests, including in ways that could permit a trustee to shield assets from being counted toward Medicaid eligibility. • S.3673 (Kenneth LaValle)/A.8424 (Magee)- Allows volunteer organizations to submit up to three applications to the higher education services corporation for voluntary recruitment scholarships. • S.4029-D (Volker)/A.6250-D (Peoples)- Would more strictly regulate scrap metal transactions, amend penalties for violations (including making it harder to prosecute the thieves), and create a Scrap Metal Task Force to recommend further amendments. • S.4249 (Serphin Maltese)/A.891 (Steve Englebright)- Prohibits public universities and community colleges from licensing their trademarks for use on unlawfully manufactured apparel. • S.6260 (Thomas Libous)/A.9153 (Jose Peralta)- Limits workers' compensation benefits secured by the New York black car operators' injury compensation fund to injuries arose out of and in the course of providing covered services while on a dispatch from a central dispatch facility. • S.6721-A (Dean Skelos)/A 9683-A (Rory Lancman)- Requires the Office of Homeland Security to study and make recommendations by Dec. 31 regarding a grant program to assist non-profit institutions to enhance their security from threats of terrorism. • S.6780 (Joseph Robach)/A.11126-A (Peter Abbate)- Prohibits the State Civil Service commission from designating a SUNY position in the unclassified service if that position is the same or is substantially similar in the scope and duties as existing positions in the classified service. • S.6837 (Joseph Griffo)/A.9854 (Magee)—Allows the city of Sherrill to appoint John Sirles to a full-time competitive position as a police officer even though he is over age 35. • S.7226 (Thomas Duane)/A.11632 Rules (Linda Rosenthal)- Establishes Haley's Act which prohibits direct contact between a big cat and a member of the public. • S.7339 (Charles Fuschillo)/A.10448-A (P. Rivera)- Prohibits credit card issuers from increasing interest rates or imposing fees based on the holder's indebtedness or late payment to another creditor. • S.7472 (Little)/A.10800 (Bob Reilly)- Excludes the depreciation of assets owned by all selfemployed individuals, as opposed to only farm operators, for purposes of determining Family Health Plus eligibility. • S.7625 (LaValle)/A.10618 (Fred Thiele)- Ratifies and authorizes reimbursement for certain special education expenses incurred by the East Moriches Union Free school district. • S.7849 (Robach)/A.4128 (Nick Perry)- Requires employers to provide to employees injured on the job all information necessary to file a workers' compensation claim. • S.8047-A (Thomas Morahan)/A.11499 Rules (P. Rivera)- Requires OMH and OMRDD to establish minimum training requirements for board members and trustees of voluntary not-for-profits under their jurisdictions. • S.8294-A (Bonacic)/A.10000 (Jeffrey Dinowitz)- Requires insurers to pay basic economic losses arising from an insured's injuries from driving while intoxicated or impaired by drugs and to seek recovery of those payments from the insured if convicted of such offense. • S.8357 (Seward)/A.11485 Rules (Morelle) - Permits shortterm health insurance policies for individuals ages 19-26 who has lost coverage as a dependent under a parent's policy and is not eligible for employer-sponsored coverage. • S.8362-B (Martin Connor)/A.11364-B (Joan Millman)- Provides that the distance between certain premises and schools and places of worship shall be measured from property line to property line • S.8363-A Rules / A.11347-A (Dede Scozzafava)- Allows the Norwood-Norfolk Central School District to repay state aid overpayments over a term of six years. • S.8364 Rules / A.11212 (Scozzafava)- Allows the South Lewis Central School District to repay excess state aid payments over a term of six years. • S.8515 (Michael Nozzolio)/A.11641 Rules (Kolb) - Allows the Southern Cayuga central school district to repay excess state aid payments over a term of six years.
